3. Professional services
3.1 Engagement terms
Professional services engagements are governed by a separate Statement of Work (SOW) or Services Agreement signed between eNeoteric and the customer. In the event of conflict between these Terms and Conditions and a signed engagement agreement, the engagement agreement prevails.
3.2 Limitation of liability
eNeoteric's liability for any claim arising from our services is limited to the fees paid by the customer in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages. This limitation does not apply to death or personal injury caused by our negligence, or to fraud.
3.3 Confidentiality
eNeoteric treats all customer information as confidential and does not disclose it to third parties except as required by law or as necessary to deliver the agreed services. Engagement-specific confidentiality terms are set out in the relevant SOW or NDA.
4. Governing law
These Terms and Conditions are governed by the laws of India. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India. We encourage customers to first attempt resolution through our complaints process at [email protected] before commencing legal proceedings.
5. Changes to these terms
eNeoteric may update these Terms and Conditions from time to time. The effective date at the top of this page indicates when the current version took effect. Continued use of our website or services after an update constitutes acceptance of the revised terms. For material changes, we will notify registered users by email.
